On May 9th, U.S. District Judge Paul Grewal issued an order granting a motion to compel non-party Google to provide it Google's search terms and custodians to Apple pursuant to a Rule 45 subpoena. Apple v. Samsung 2013 BL 124263 (N.D. Cal. 2013). The case is not (yet) in Westlaw's database (so far as I can determine).
The court also was not impressed with Apple's degree of "cooperation."
