2014-02-15 - The Internet of Things: And Electronic Discovery

Where do FitBits and other interconnected devices with embedded code fit into the eDiscovery universe? For insurance companies, it may be helpful to know what a health monitoring device recorded when a claim for injury is made. Do the readings of the health monitoring device match what should have been the readings when an injury (such as a heart attack) is asserted in a claim for treatment reimbursement? How is this information gathered, interpreted, collected and preserved? How might it be authenticated? And who really owns the data collected?

Stay tuned for what is sure to be a tidal wave of liaibility, discovery and evidentiary issues.
